Prosecutors seeking to upgrade six-time Paralympics gold medallist Oscar Pistorius' conviction from culpable homicide to murder have been given a court date of November 3.

The 28-year-old double amputee sprinter was jailed for five years for killing his girlfriend Reeva Steenkamp, but it is claimed that Judge Thokozile Masipa made mistakes during his trial and this penalty wasn't harsh enough.

Pistorius claims he mistook Miss Steenkamp for an intruder when he fired four shots through a bathroom door on Valentine’s Day in 2013, but prosecutors say he must have known the person behind the door could be killed.

They will ask a panel of five judges to quash the culpable homicide verdict and instead upgrade it to murder.

Options available include finding him guilty of murder, ordering a new trial or deciding that Masipa's original verdict should stand.

Meanwhile, Pistorius, who has served ten months of his five year sentence, is also due to face a parole board hearing to see if he can be released from prison early.

Under South African law, an offender is eligible for release after serving one-sixth of a jail sentence of five years or less.

He was due to be released on house arrest in August but this was blocked by South Africa's justice minister and the case was sent to the parole board.

This hearing was initially supposed to be held last week but the case was delayed by a fortnight.
